Your access to and use of information on this website, including the rental of clothing through our facilities, are provided subject to the following terms and conditions. It is the customers (lender or renter) responsibility to read and adhere to the following terms and conditions. Conducting a hire or listing an item through us constitutes the acceptance of our terms and conditions. Failure to read or abide by them is Your misdoing (the customer) and not the responsibility of Lend Her Look. Lend Her Look also reserves the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions. We therefore recommend that each time you access our website you read these terms and conditions. Renters and lenders have the liberty to discuss transactions and specification of hire, so long as they do not conflict with these terms and conditions.
Our services are provided to adults over the age of eighteen (18) years. By proceeding to transact or rent through our website, you acknowledge that you are over 18 years of age.
Lend Her Look is platform for renters and lenders to connect with one another through direct message and comment posts on listed products. We strive to ensure that the listed products are described as accurately as possible on our website, however we do not warrant that the description is accurate. Where we become aware of any incorrect description, we and the Lenders or Owners reserve the right to correct any error or omission without notice.
Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.
Lend Her Look also does not take ownership for any images posted on our website by lenders or renters, and the responsibility is held by the renter or lender themselves.
In addition to the payment of the applicable rental price for goods delivered through the Website and/or Mobile Apps, Renters or Lenders are responsible for paying all other costs which may include shipping, transport or postage costs and any other costs displayed, such as insurance (if applicable) or cleaning, our service fees, and all applicable sales, GST and other taxes associated with the rental of any Items through the Website (Associated Costs).
Renters and lenders can negotiate on the rental price of an item; however, renters must respect the lender’s decision on the rent amount.
Payments between renters and lenders are in the sole responsibility of the two parties involved and Lend Her Look is not liable for payment disputes or failed payments.
Wearing of a Hired Item:
A customer must pay for the possession and responsibility of an item before they receive the piece(s), regardless of whether they end up wearing it or not. However, an item is rented out for ONE event only, and to ONE person only, unless otherwise arranged with the owner.
An item that is in the possession of a customer for a weekend cannot be lent to their friend, and worn on two occasions, even if worn by the same person, unless this is agreed by the owner. This is because as an item is worn, it depreciates in value and faces the risk of damage and deterioration. Therefore, the hire price covers the cost of one occasion, day or event only.
Condition of An Item:
It is an owner’s responsibility to provide the customer with an item that is in wearable and undamaged condition. Small stains, that are hidden or barely noticeable, are accepted. However, please disclose these stains to the customer before they hire the item. A customer has the right to refuse to wear an item, if a reasonable person, in this position, would also view the item as un-wearable.
An item that has small stains, but is still wearable can also be refused by the customer, if these damages were not disclosed prior to the rental.
In the scenario of a marked or damaged item, it must be immediately returned to the owner, and a full refund be issued. If disputes between owner/customer occur, please send in a detailed complaint, along with photo evidence to Lend Her Look, and we will determine whether the damage makes the item un-wearable or not.
If a bond has been used in the transaction, it must be returned on return of the item if it is in the same condition. If it is not, not all the bond may be returned. Bonds which have not be claimed after 2 weeks (14 days) after the lender has attempted to return it, asked for bank details etc. and the renter has not gotten back to them, the bond cannot be claimed. Please make sure you provide your lender with the appropriate bank details or arrangements when they ask. Do not expect them to chase you up for them.
If an item is returned to a lender in a state worse than it was received by a renter, the lender has the right to keep some, if not all, of the bond that was paid by the renter.
Please refer to ‘Dispute Resolutions’ below for more information on what to do if You (the lender) believe that the damage to an item is worth more than the bond price.
If a customer agrees to hire an item, money is exchanged, and then the customer later decides they do not wish to hire the item, the lender has no obligation to return the hire price. Especially in scenarios where the dress has already been given to renter. This is a condition as our items are extremely popular, and often clients are turned down as the item is already rented out, and we can therefore not turn down customers if the dress has not already been definitely hired out.
However, if for a reason relating to the quality of the Items received, the Renter or Borrower is unhappy with their transaction through the Website, the Renter must notify the Lender immediately upon receipt. Where the Renter receives the Items from the Lender, the Renter must refuse the Items immediately if they are unhappy with them. The Renter will not be able to make a return pursuant to this clause if they accept the Items, or be seen as having accepted the Items, or do nothing.
Where the Renter chooses for the Items to be delivered and the Items do not match those ordered or are faulty to the extent that they cannot be worn, the Renter must notify the Lender within 2 Hours of receipt. In circumstances where the Items are not faulty and they correspond to the Order, the Renter is not entitled to any refund, exchange or credit note.
The Renter shall pay for the costs of delivery or any other associated costs when returning the Items.
If, due to a fault a Refund is payable, refunds will only be credited to the original payment method used. Save for when the Items are faulty or clearly not fit for purpose, and the dispute resolution process has firstly been followed, the refund does not include any shipping or handling costs or administration fees charged for use of a credit card.
If you are unsure whether you are interested in the dress, please ask the owner if they will allow you to organise a try on. Our services allow renters and lenders to deal with one another in close proximity, so the ability to try on desired outfits is very likely.
However, a change of mind is allowed at least 2 weeks prior to the event, so if the money has already been exchanged, and there is a change of mind with the event not taking place till 15 days later (for example), the lender is obligated to refund the full hire price and any bond amount to the customer.
In the event of a dispute, Renters and Lenders must always first contact each other in good faith, and with every intention of satisfactorily resolving the dispute with each other.
If a dispute cannot be resolved by the first step indicated directly above, then either the Lender or Renter must contact Us (Lend Her Look) within 48 hours of the dispute arising and provide details of the dispute, including when the dispute first arose. Our contact details are available on the Lend Her Look website.
You agree, whether you are either a Lender or a Renter, that any final decision by Us, in relation to a dispute of any kind whatsoever, is binding on you and all parties to the dispute.
It is the customer’s responsibility to contact the owner of the item, regarding its return. Items must be either dropped back, or posted back to the lender by the date stated, unless other arrangements are agreed upon. Customers with items which are not returned within one week of the date of wear, are no longer entitled to receive their bond upon return, unless the owner has agreed to a date of return later than one week.
The lender also has the control to charge the renter the Recommended Retail Price of the item if it is not returned at all.
This transaction can be taken from the renter’s credit card details noted on the Lend Her Look website. Lenders must contact Lend Her Look in any circumstance where this occurs, as We will be in charge of crediting the lender with the renter’s payment.
If an item is to be posted, please forward on a tracking number to the owner/customer. Please always include a return address of the item. This ensures that an item can be tracked, in the event it were to be lost in the mail. If an item does not arrive at it’s destination, and there were no tracking number given, the person who sent the item is responsible for the compensation of it.
Lend Her Look recommends that lenders charge a dry cleaning fee with every listing. However this is at the lender’s discretion, and if they do not wish to have the item dry cleaned by the renter upon return that is accepted. Should an item fail to be appropriately cleaned before return, as stated by the owner, the owner has the right to withhold a partly amount, if not the entire amount of the bond, to cover the costs of cleaning.
Removal of a Lender:
Lend Her Look has the right to remove an owner’s item/s from our page, and ban them from renting out in future, should we deem a lender to be conducting themselves, and their rentals, in a way which is not reflective of the transactions we encourage, and approve on our page.
The following discretion’s could warrant removal:
- Providing renters with un-wearable items
- Refusing return of a bond, in situations where a bond is entitled to be refunded
- Using explicit, threatening and abusive language
The removal of an owner is at the discretion of Lend Her Look. If you have an owner complaint, please send in your complaint to us, along with evidence, such as “screenshots” of conversations. We will determine the best way in which to deal with our owner.
This page and Our website is supposed to help girls find the perfect dress without paying too much. Bullying, harassment, nasty comments, derogatory terms or anything seen as negative or unfit for this page will not be tolerated, will be deleted and depending on the scale of the incident, the person responsible may be blocked.
Lend Her Look shall not be held liable nor accountable for the proceedings that occur between a renter and lender, through our page. Should an issue occur, we will be more than happy to give our opinion, with regards to the above binding terms and conditions. We will remove an owner, or ban a customer should they behave in a manner deemed inappropriate, or fail to take our advice on a situation. We cannot however, offer compensation.
By accessing our Website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our Website.
By accessing our Website, you agree to waive all rights to any class action against Lend Her Look.
We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services we have supplied.
We do not accept liability for anything contained in the post of a user or in any form of communication which originates with a user and not with Us. We do not participate in any way in the transactions between our users.
We endeavour to take all due care with any information which you may provide to us when accessing our Website.
